Three Arizona Charter schools have been fined by the US Environmental Protection Agency (EPA) for violations regarding the ‘AHERA’, the Asbestos Hazard Emergency Response Act. The Act is in place to regulate, inspect, catalogue and handle asbestos in all US schools.

The law has been in effect since 1986 and outlines 8 steps that must be taken to ensure that students and staff are not exposed to asbestos. These steps include instructing maintenance staff on asbestos awareness and handling, conducting a six month periodic survey of asbestos sources, creating an asbestos management plan that is accessible to all staff and parents, ensure ongoing documentation of all asbestos related activity.

The use of asbestos is outlawed so these rules exist to ensure that any pre-existing material is monitored by trained professionals and to make sure it isn’t damaged by renovations or age. The EPA considers asbestos safe as long as it is in tact but once broken or exposed, it releases microscopic fibres which can lead to several forms of unique yet fatal cancer.

The best known asbestos related disease is Mesothelioma, a form of cancer that breaks down the protective linings surrounding the lungs, heart and organs. The disease generally lies dormant for up to five decades, making it notoriously difficult to monitor or catch at an early stage. Once it appears it usually means the victim has around twelve months to live.

The Arizona schools were found to be failing to conduct initial inspections or developing an asbestos management plan. There were five other schools that broke similar regulations but were found to not contain any asbestos.

The schools were fined a total of nearly $30,000 and are now all in compliance with AHERA regulations. One of the worst offenders, Cave Creek High School in Phoenix, was fined for failure of ongoing inspections after it documented 12,580 square feet of asbestos-containing building material on its premises.

Following the publication of these breach of regulations, many of the students have undergone health checks to make sure they were not affected by any exposure, if so they could be eligible for a mesothelioma claim as long as they hire a decent asbestos lawyer.

Mesothelioma is a rare cancer which usually occurs on the outer surface of the lungs, and most who are diagnosed have been in prolonged contact with asbestos, although it can occur in those who have never been exposed .

Mesothelial cells are cells which surround all our organs and it is in these that the Mesothelioma cancer occurs. There are three types of mesothlial cells, Epitheliod, Sacromatoid and Biphasic, and in cases of cancer one or more of these may be present in different combinations.

Epitheliod cells are the most common cancer cells and usually make up anywhere between fifty and seventy percent of cells in malignant mesothelioma. The cells themselves are formed in a cubed shape and are arranged in a uniform tubular pattern.

This type of cell is often misdiagnosed as they have a similar appearance to adenocarinoma cells, although if the cells are inspected under a high power microscope then a proper diagnosis can be made.

Biphasic Mesothelioma cells are less common than epitheliod, but are not the least common type. They make up twenty to forty percent of mesothelioma cancer cells and are created as a combination between the other types of cell. The biphasic cells usually occur when the epitheliod and sacromatoid cells combine continuously through a tumour.

The last type, sacromatoid mesothelioma cells, are least common of the three, only making up on average between ten and fifteen percent of mesothelioma cells. These cells have an irregular oval shape where the nucleus is not visible, which makes them difficult to tell apart from the more common sarcoma cells.

Whether sacromatoid, epitheliod or biphasic cells are present the options for treatment are the same and include surgery, chemotherapy and/or radiation therapy, as more traditional treatment methods. However recent research has shown more and more untraditional methods are becoming more successful.

Asbestos illness is a common concern these days. There is a great deal about diseases related to its fibers. What exactly is it? Where will you find it? What can you do about it? Here is some important information to consider.

Asbestos is a fibrous mineral that is found naturally in the environment. The fibers are very tiny. You cannot see them. Water will not dissolve them. Heat has little effect on them. Neither do most chemicals. There are two major types, chrysotile and amphibole. Chrysotile is the type normally referred to in industrial settings. Amphibole is not used as much. Although long term exposure is a danger, amphibole’s may be worse. It has longer fibers and stays longer in the lungs. Asbestos’s ability to resist fire caused widespread use in the past. Places where fire was a problem were insulated with material made from asbestos. Things like boilers and furnaces were insulated. Fireproof protective equipment is another use. In the past, it was used in a large number of applications. However, a lot of companies have phased it out, due to illness possibilities. The risk is still there. It might take many years before any symptoms could turn up.

Old houses and anywhere asbestos has been used will present an exposure risk. Old waste sites and dumps are another good source. In the past, it was a big concern for workers. Anyone that made materials like brake linings and fireproof materials would be at risk. Construction workers could also be at risk. There are two major types of asbestos related illnesses. There are cancerous and non-cancerous conditions.

Benign conditions: The lungs become damaged and scarred with asbestosis. This is brought about by many years of high-level exposure. If you smoke, your chances of asbestosis are considerably higher. You would develop a severe cough. You might even cough up blood. You may have shortness of breath when doing normal things. You would have any other symptoms associated with limited lung function.

Another non-cancerous condition is pleural plaques. The lining of the lungs, called the pleura, is affected. It becomes very hard. It also thickens. This will reduce breathing ability. When that happens, patients can quickly become tired and easily winded with little excursion.

Cancerous conditions: Lung cancer is a condition known to be related to long term asbestos exposure. If you add cigarette smoking to the picture, the risk increases. It may be hard to determine the cause of some lung cancers, as they may appear similar to disease caused by smoking. Mesothelioma is a rare form of cancer from long term exposure. It may affect the lining of the lungs. It may also affect the abdomen. The Unites States sees about three thousand new cases of Mesothelioma annually. Normal lung cancer symptoms will usually present. The prognosis for these diseases can be very grim. Early treatment is the best chance.

Treatment possibilities: Get influenza shots. Check into pneumonia vaccinations. See a doctor regularly. Prevention is the best thing to do. Do not smoke. Cancer treatments are the same as for other lung cancers. They are radiation, chemotherapy, or surgery.

In closing: The more you know, the better off you will be with this concern. The effects of asbestos can be devastating. To help avoid future health problems, practice good health habits. See a doctor on a regular basis. The sooner you get treatment, the better your chance for survival.

The link between mesothelioma and asbestos was not established until 1960s. Asbestos is a natural compound mined out of the earth and has been terribly useful in making a wide range of materials like cement, ship building and so on. Its use increased since 1940s and many millions of people all over the world were employed in extracting, processing and commercial activities. Since no one suspected any side effects, no precautions, in the slightest, were taken by the companies to guard their workers from inhaling or consuming its flying fibers.

The health of the workers was in peril since they were inhaling asbestos particles. Not only that the family members were also infected through the dangerous particles carried home through their dress or hair. This happened since the workers went back home without a shower or changing of cloths. As soon as the connection between mesothelioma and asbestos was established, restrictions were put forth by the governments regarding the use of asbestos. Some countries even banned the use of the product. But it was too late since many were already infected as there exited no precautionary measures earlier.

Once asbestos particles are inhaled through the air, they reach the protective lining of the lungs and get collected there. As a result of this, chemical reactions are set off which result in the abnormal and uncontrolled division of mesothelioma cells. This continues for a long span of time, the cancer spreads and symptoms start appearing. Thus mesothelioma and asbestos have a close connection.

Mesothelioma is the deadliest of all diseases like lung cancer caused by asbestos. Various precautionary measures are taken these days like wearing protective masks, bathing and changing cloths at work place etc. In spite of this mesothelioma cases are still reported, though rarely. About 3000 people are diagnosed of carrying this disease every year in United States alone. The number would be much more around the world. The sorry state of affairs is that in spite of the link between mesothelioma and cancer many countries have not made asbestos laws and unscrupulous employers still exploit workers to satisfy their greed.

Since there is an umbilical relation between mesothelioma and asbestos, employees are entitled to financial compensation. The amount, that may run to millions, can help to cover treatment expenses and loss of revenue.

Ever since the late 19th century, asbestos was used in many industries and in many products and it is a natural occurring mineral composed of small, strong fibers in the U.S. Asbestos exposure risks were unknown during that time. But it is now well-documented that heavy or long-term exposure to asbestos raises the risk of a number of deadly cancers, including:

Mesothelioma – This is an extremely rare cancer, though the number of diagnoses has increased in recent years. It is almost only connected to asbestos exposure and about 2,000 people are diagnosed in the U.S. yearly.

There are three types of mesothelioma, classified according to where the cancer originates. Pleural mesothelioma begins in the protective membrane surrounding the lungs (pleura) and spreads from there. Peritoneal and pericardial mesothelioma are uncommon and it affects the lining throughout the abdominal cavity and heart.

Individuals diagnosed with mesothelioma usually have a poor prognosis since the illness is typically not detected until it is in later stages. This is why symptoms of mesothelioma do not typically show until two to five decades after being exposed to asbestos.

Lung Cancer – Lung cancer is more common than mesothelioma, but there are also many more environmental factors that increase the risk of this deadly disease. One cause of small cell lung cancer and non-small cell lung cancer is asbestos exposure.

Laryngeal Cancer – Asbestos exposure is also linked to cancer of the larynx, or voice box. Symptoms of laryngeal cancer include sore throat, hoarseness and pain in the ear; the prognosis depends on what stage the cancer is in at that time.

Kidney Cancer – Many studies have linked exposure to asbestos to an increased risk of kidney cancer. Additional research has suggested a link between asbestos and other cancers such as colon cancer, intestinal cancer, esophageal cancer and cancer of the gallbladder.

Who is at Risk for Asbestos Cancer?

Prolonged or heavy exposure to asbestos most frequently occurs in certain workplace environments. Some occupations where the risk of asbestos exposure is greatest include:

Construction and demolition
Shipbuilding and shipyard work
Drywall installation and removal
Automotive brake repair
Firefighting

The reason asbestos exposure is so dangerous is that when asbestos-containing materials are damaged or disturbed, the fibers may become airborne and individuals may unknowingly inhale them. These fibers are microscopic and can become lodged in the lungs or other tissues and organs, the development of cancer and other non-cancerous conditions can result like asbestosis (a chronic lung ailment).

Not every instance of asbestos exposure can be prevented but often times, employers have a duty to try to decrease the risk of being exposed and also teach employees preventative procedures. If you have developed cancer because of exposure to asbestos, you may have a right to compensation. Talk to an experienced attorney now for an evaluation of your case at no cost to learn more about your legal rights.

Over 3,000 people died in the 2001 terrorist attacks on the September 11th attacks in New York but the death toll is set to rise due to a hidden killer. The Twin towers which dominated the Manhattan skyline were completed in the early seventies and experienced much of their construction during a period in which Asbestos was perfectly legal.

The toxic material was banned around the time the builders had completed the 40th floors and some alternatives were then used but there was no rule forcing builders to remove the existing asbestos for which the cost would be more than the value of the buildings.

When the terrorists hijacked the aircraft and crashed them into the towers the subsequent collapse of the buildings released hundreds of tonnes of the toxic material into the air which remained present for over 5 weeks. The dust eventually settled but it covered most of downtown Manhattan including air conditioning systems, buildings, furniture and walls, most of which are permanently contaminated.

Despite the Environmental Protection Agency declaring the city safe for residents just a few days after the event many thousands of workers, volunteers and residents had already been exposed and if not were putting themselves at maximum risk by returning to the area. A study discovered that 76% of all surviving first responders, workers and local residents are already suffering from respiratory problems.

Approximately 100,000 people have been exposed to toxic materials which could develop into a variety of diseases such as Asbestosis, Lung Cancer and Mesothelioma in years to come.

In 2006, New York City Fire Official Deborah Reeve died of Mesothelioma and was declared the first fatality of the 9/11 attacks directly linked to an exposure to asbestos. However authorities expect many more cases to emerge in the coming years.

Anybody that is diagnosed as having mesothelioma and has worked somewhere where they have been subject to asbestos exposure must look into getting legal advice to find out if they can bring a civil law personal injury claim for mesothelioma compensation from their employer.

Anyone that is diagnosed as having mesothelioma and has worked somewhere where they have been subject to asbestos exposure should consider obtaining legal advice to see if they can bring a civil law personal injury claim for mesothelioma compensation from their employer.

As mesothelioma claims undoubtedly are a very specialised area, when getting in touch with compensation lawyers or a mesothelioma law firm it is always wise to ask:

When making a mesothelioma claim does the attorney specialise in asbestos cases and asbestos claims. Are they fully conversant with asbestos law and specifically mesothelioma law and mesothelioma litigation?

How many mesothelioma compensation cases has the attorney handled?

How many of these mesothelioma claims have in fact come to court? (Often cases are settled out of court which may be preferable to you)

How many asbestos claims has the attorney successfully dealt with in the past three years?

Would you be required to pay the mesothelioma lawyers ? Or will they work on a no-win/no-fee basis? This tends to be the norm and it is highly recommended that you get an attorney that will work on this basis. Find out how they get paid for acting for you.

In the case of the mesothelioma compensation are there any added expenses you may be expected to pay, such as court costs and court fees?

How will you be kept informed on what exactly is happening with your claim for mesothelioma compensation ?

How long will the mesothelioma claims process take?

How soon does the attorney expect to start a court action?

For the mesothelioma compensation claim to be successful you would need to show that:

It is likely that your mesothelioma compensation claim is because of exposure to asbestos during your work. It might be hard to prove, so the legal phrase is that ‘on the balance of probabilities’ the asbestos exposure caused the condition. Which means it cannot be certain that the mesothelioma was a result of one or more jobs, it is more likely than not that it was.

And

Your employer at the time was careless (negligent) in not keeping up the standards required by common law.

It may be possible to sue your employer for specific offences against health and safety regulations.

If a previous employer has gone out of business it may be possible to make a mesothelioma compensation claim against the firm’s insurers.

As you can see there is quite a lot to consider when making a claim for mesothelioma compensation BUT if you ask the right questions you should have no problems.

The very first asbestos related lawsuit was filed in 1966, and since that time hundreds of similar cases have been decided in favor of the victims that resulted in millions of dollars in cash settlements.

As far back as the 1920s companies possessed information informing them just how dangerous it was for their workers to work in and around asbestos. By the 1940s they were being told to quit using asbestos in their manufacturing processes. They didn’t listen, though, due to the fact it would have meant reduced profits for the company. Instead, they made the decision to ignore the findings and permit their employees to continue working in unsafe conditions. This practice continued until the mid 1970s. As a result, thousands of workers inhaled asbestos fibers which could cause this devastating form of lung cancer.

Don’t hesitate to file a lawsuit because you’re afraid of what an expert lawyer is going to cost you. These people are well aware of the lost wages and medical bills you’re already facing, and so they work on a no win, no fee basis. By so doing they guarantee that they will win your case and get adequate restitution for you or else the work they put in will be given free of charge.

Begin by searching for an asbestos lawyer at bar associations, the Yellow Pages, the web etc. The web is a superb place to search out asbestos or mesothelioma lawyers as you could find reports on the various firms. To practise in asbestos litigation does not need any certifications so attorneys mightn’t have “asbestos” listed as one of their specialties. It is your job to ask. Look for an asbestos lawyer that is a member of trustworthy statewide or nationwide attorney network.

1.Step 2

Learn how expertised the lawyers are at working on asbestos related cases. Discover how many mesothelioma lawsuits they’ve taken on and find out how many asbestos litigation cases they have WON. You want an attorney that has won more cases than not.

2.Step 3

You will want to locate an asbestos lawyer that’s eager to take on your case. You might not have to go to court because a lot of asbestos claims are settled out of court. You should want a litigation firm nonetheless that is going to put every thing they’ve got in to winning your mesothelioma case.

3.Step 4

Discover how many asbestos related resources the lawyer has at their disposal. For instance: do they have inspectors that they work with that concentrate on asbestos cases, people who work with asbestos product detection, and or people that have worked on sites contaminated with asbestos fibers (contractors, etc.) that they can refer to for assistance. You need an asbestos attorney which has some resources available

A type of cancer that is usually developed by exposure to asbestos is mesothelioma. A group of minerals called asbestos are created in our surroundings. It can be life-altering to those exposed to it and this exposure can lead to mesothelioma. There is no ruling out the state of New Jersey (NJ) since the disease affects individuals all over the world. There are a lot of factories, ports, and industries that come from the state of NJ, which is why mesothelioma cases are seen to be on the rise there.

How Do You Get Mesothelioma?

Mesothelioma is neither genetic nor a contagious illness. Being exposed to fibers of asbestos can cause the particular form of cancer. Even though asbestos is banned in many other countries, there are still places throughout the world, including the United States that use the substance to mine and in other industries. Typically, and in the recent cases of NJ mesothelioma that are being brought to the attention of the public, mesothelioma is not detected until later in life. Those in NJ who have mesothelioma, it is frequently found that they developed the condition because of primary exposure. Although, NJ mesothelioma cases involving secondary exposure are steadily becoming more common.

Someone can develop mesothelioma directly through exposure at the workplace or at home. However, those who have indirectly been exposed to asbestos can also be affected. For instance, if your husband works in a factory all day and brings asbestos home on his clothing that you wash and handle daily, you can become exposed. Whether you have primary or secondary contact with asbestos, it can be deadly if you are exposed.

What Accounts for All the NJ Mesothelioma Cases?

In 1999, statistics show in NJ, mesothelioma accounts for more than 2,485 deaths. These deaths have been linked to a variety of professions throughout the states, but have mainly been found to be linked to shipyard and roofing work. Then what makes NJ one of the highest ranking states where death was due to mesothelioma?

There are several reasons that NJ has the eighth highest level of mesothelioma deaths and the sixth highest mortality rate in the U.S. One of the main reasons is the fact that the shipyards in NJ, such as Hoboken Shipyards and the Kearney Federal Shipyard, use materials that contain asbestos. Asbestos has also been found to be widely used in roofer shingles throughout the state and in the factory heating plants and assembly lines.
